Article 1 — Definitions
Swivre Members: the VOF (general partnership under Dutch law) that operates the private shopping club, hereinafter also referred to as "we" or "us".
Member: the natural person who has taken out a paid membership.
Portal: the digital members’ platform accessible via www.swivre.com through which benefits are made available.
Brand Partner: the brand or retailer that offers exclusive privileges, vouchers and discounts to members via the portal.
Voucher / Offer: a discount code, cashback deal or exclusive privilege provided by a Brand Partner.
Membership Period: the period for which membership has been taken out.
Consumer: a member acting for purposes outside their trade, business or profession. EU consumer protection law applies to all such members.
Article 2 — Membership and Access
A membership is strictly personal and non-transferable. Sharing login credentials or benefits with non-members is prohibited and may result in immediate termination without refund.
Membership is open to natural persons aged 18 or older who are resident in the European Union.
Swivre Members reserves the right to decline a membership application without stating reasons.
Each member may hold only one active membership account at a time.
Article 3 — Offers, Pricing and Payment
The current membership fee is stated on www.swivre.com. All prices include VAT where applicable under applicable EU law.
Payment is made in advance via the payment methods available in the portal (processed by Mollie Payments B.V., a licensed payment service provider). If payment is not received on time, access to the portal may be suspended until payment is settled.
Swivre Members reserves the right to adjust membership fees. Any price increase will be communicated by email at least 30 days before it takes effect. In the event of a price increase, the member has the right to terminate the agreement before the new price comes into force.
For members in the EU, all applicable consumer rights under Directive 2011/83/EU (Consumer Rights Directive) apply.
Article 4 — Right of Withdrawal and Refund
As a consumer in the EU, you have the right to withdraw from the agreement within 14 days of signing up, without giving reasons (statutory right of withdrawal under EU Directive 2011/83/EU).
If you have not yet used any benefits in the portal during this period, you are entitled to a full refund. By explicitly requesting immediate access to the portal and using benefits within the withdrawal period, you acknowledge that your right of withdrawal is forfeited for the portion of service already delivered.
After the withdrawal period, or after benefits have been used, no (partial) refund of the membership fee will be made, including in the event of early cancellation.

Article 5 — Duration and Cancellation
A membership runs annually and renews automatically. Though, you will receive an update on the renewal. Cancellation must be made no later than 30 days before the next renewal date via the portal or by email.
After cancellation, access remains active until the end of the paid period. No partial refund is provided for the remaining period.
Swivre may terminate the membership with immediate effect in the event of material breach of these terms, including misuse of the portal or fraud.
Article 6 — Nature of Benefits
Swivre Members provides access to exclusive privileges, vouchers and offers from Brand Partners. These benefits are offered by the Brand Partners themselves. Swivre Members acts as an intermediary and is not a party to the purchase agreement between the member and the Brand Partner.
Swivre Members is not liable for:
• the quality, accuracy or availability of products or services offered by Brand Partners
• a specific voucher or offer no longer being available
• errors or technical issues on the part of the Brand Partner
• any dispute between a member and a Brand Partner regarding an order, delivery or return
The selection of Brand Partners and available offers may change at any time. Swivre Members strives to maintain a qualitative and varied offering but does not guarantee a minimum number of offers or the continued participation of specific Brand Partners.
Article 7 — Use of the Portal
The member is responsible for keeping their login credentials confidential. Suspected misuse must be reported immediately to info@swivre.com.
The following are prohibited: use of the portal for commercial purposes, automated access, scraping, reverse engineering, or any action that disrupts the platform.
Swivre Members reserves the right to terminate a membership immediately and without refund in the event of misuse, fraud, or violation of these terms.
Article 8 — Personal Data and Privacy
Swivre Members processes personal data in accordance with the GDPR (EU Regulation 2016/679) and our Privacy Policy, available at www.swivre.com/privacy. As a member, you have the right to access, correct, and delete your personal data.
Payment data is shared with Mollie Payments B.V. as a processor under a data processing agreement. Swivre Members does not share personal data with Brand Partners without the member’s explicit consent.
For members in the EU, data is stored on servers within the European Economic Area (EEA). Cross-border transfers outside the EEA will only take place under appropriate safeguards as required by the GDPR.
Article 9 — Limitation of Liability
The total liability of Swivre towards a member is limited to the amount paid by the member in membership fees in the three months preceding the event giving rise to the claim.
Swivre is not liable for indirect damages, consequential loss, or loss of profit. This limitation does not apply in cases of intent (opzet) or gross negligence (grove nalatigheid) on the part of Swivre Members.
Nothing in these terms affects mandatory consumer rights under applicable EU law, including rights under the Consumer Rights Directive and national implementing legislation.
Article 10 — Amendment of Terms
Swivre Members may amend these terms at any time. Amendments will be communicated by email at least 30 days before they take effect. If a member objects to the amended terms, they have the right to terminate their membership free of charge before the effective date. Continued use of the portal after that date constitutes acceptance of the amended terms.
Article 11 — Governing Law and Disputes
These terms are governed by Dutch law. Any disputes will preferably be resolved through mutual consultation. Members who are consumers in the EU may also submit a complaint via the European Online Dispute Resolution platform at ec.europa.eu/odr.
If a dispute cannot be resolved amicably, it will be submitted to the competent court in the district of Swivre Members’ registered office in the Netherlands. For EU consumers, mandatory local consumer protection rules in your country of residence continue to apply and are not affected by this clause.
